Where Criminal and Immigration Law Intersect

 

Criminal charges and convictions can have serious immigration related consequences for foreign nationals and permanent residents in Canada. At our firm, we assist clients whose immigration status is affected by criminal allegations, inadmissibility concerns, detention, or removal-related proceedings.

 

We represent clients in matters before the Immigration Division, including detention reviews and admissibility hearings. Our approach is focused on protecting our clients’ liberty, immigration status, and long-term future in Canada.

 

Detention Reviews
 

We assist clients who have been detained by immigration authorities and advocate for their release at detention reviews. This includes preparing release plans, presenting bondspersons, proposing conditions, and making submissions on alternatives to detention.

Immigration detention reviews generally take place in three stages:

 

  1. 48-Hour Detention Review
    The first detention review is held shortly after a person is detained. At this stage, we act quickly to assess the grounds for detention, prepare an initial release plan, and advocate for release at the earliest opportunity.

 

  1. 7-Day Detention Review
    If the person is not released at the first review, a second review is held within seven days. At this stage, we work to strengthen the release plan, address any concerns raised by the Minister, and present further evidence in support of release.

 

  1. 30-Day Detention Reviews
    If detention continues, the person is entitled to ongoing reviews every 30 days. We continue to challenge the need for continued detention, present updated evidence, and propose meaningful alternatives to detention where available.

 

Admissibility Hearings


We represent clients facing allegations of inadmissibility, including criminality, serious criminality, misrepresentation, and non-compliance under Canadian immigration law. We carefully review the allegations, prepare legal submissions, and advocate for the best possible outcome.

 

Please note: At this time, we do not accept Legal Aid certificates for criminal law or crimmigration matters.
